Obama’s S&M (Steady & Methodical) Criminalizing of Dissent (4-25-12)


On the Black Agenda Report website Jemima Pierre writes:
Clearly, and methodically, “the US government is preparing for domestic insurrection.”

In only three years, the Obama administration and its enablers have established, legitimized, and normalized a national security state apparatus that removes any doubt that domestic policing is a prelude to a totalitarian police state. This apparatus has surpassed the Bush administration’s attempts to expand executive power by crushing the civil liberties of US citizens. And it has done so boldly, with only a few prominent critics, and without so much as a whimper from so-called leftists.
December 31, 2011 Obama signed into law the National Defense Authorization Act of 2012 (NDAA). BASED ON SUSPICION ALONE the military can detain ANYONE who it considers a “terrorist” or an “accessory to terrorism.”
THIS IS THE FIRST TIME IN AMERICAN HISTORY INDEFINITE MILITARY DETENTION WITHOUT CHARGE OR TRIAL IS CODIFIED INTO LAW.

What is most dangerous about this law, according to its many critics, is its broad language about who can be considered a target. In his column describing why he is suing the Obama administration over NDAA, journalist Chris Hedges points particularly to Section 1031 defining a potential target as a person who is either a member of, or substantially supported, al-Qaeda, the Taliban, or “associated forces that are engaged in hostilities against the United States or its coalition partners.” This also includes “any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.”
The law doesn’t define what “associated forces” are, or what “engaging in hostilities” against the US means. And because the definition of a “terrorist” shifts according to political necessity, all of us – all over the world – are potential targets and eventual victims. Historically, we have seen how the US government has labeled “domestic terrorist” any persons or groups, particularly those on the left, who have dared challenge inequality and state oppression (clear examples are the American Indian Movement and the Black Power Movement). Most recently, we have seen the brutal suppression of domestic dissent through the militarized dismantling of Occupy Wall Street encampments – which brings us to the next worrisome law, HR 347.
Obama was on the Jimmy Fallon show last night I see. Trying to coax those tragically uninformed and/or with low interest in what is actually happening to and by this country, particularly those young voters who are hip but uninformed, to vote based on style NOT substance. Obama is exploiting an endorsement by CORPORATE craven media. Too many citizens are still myopically and willfully fighting Obama disillusionment or have an equally insane sensibility that Obama is too liberal and socialistic (when he is FASCISTIC) because, I grant you, the reality is just too horrible.
That smiling and amiable, seemingly self-effacing black man (driven by his own ego and his one percent puppeteers) is doing what he does best, campaigning for votes CUZ HE IS A HIP AND CHARMING CELEBRITY. His message of seduction is for you to not believe your own lying eyes and ears. Your common sense. Your brain. Your heart. To ignore or better yet, begin to groove to those sirens of cognitive dissonance bouncing around in your skull.
Obama is not just an incompetent president. He is an operative busily setting up a totalitarian government for us all. IN PLAIN SIGHT.
NDAA and the rest of the Patriot Act fathered bills of oppression???? They flush our civil protections down the toilet.
WHERE IS THE OUTRAGE AND THE BLOWBACK? Where is at least a fight for our rights? Where is our collective voice? Our consciences?
So much of the so-called progressive corporate media colludes with the destruction of our constitutional rights as it attacks the specter of a Republican administration. As if danger looms in our FUTURE. What bullshit unloaded on us all that the Democratic legacy party is wearing the proverbial white hat.
DANGER to our welfare and quality of life HAS ARRIVED!!!! We must stop ignoring it.
Kidding around late night with Jimmy Fallon gives Obama the right to trash our rights and get a shot at another term cuz he is just that cool (or “wannabe cool” more accurately)? Are we that EASY and seducible as a citizenry? DEAR GOD!
Another fresh HELL of a bill in Obamaworld is “The Federal Restricted Buildings and Grounds Improvement Act of 2011” or the “Trespass Bill” (HR 347 and its companion Senate bill, S. 1794). Obama signed it recently, March 9, 2012.
Pierre writes:
This law, according to a Business Insider article, “potentially makes peaceable protest anywhere in the U.S. a federal felony punishable by up to 10 years in prison.” What it says, specifically, is that anyone can be charged with a federal felony for “trespassing” on property or grounds that is under Secret Service protection, even if the supposed “trespasser” is not aware that the area is under such protection. One can also be charged if he or she “impede[s] or disrupt[s] the orderly conduct of Government business or official functions.”
Say what? You can be charged with a felony for trespassing on secret service protected ground even if you don’t know you are on secret service protected ground?

Also, if one is “impeding” the ORDERLY CONDUCT OF GOVERNMENT BUSINESS OR OFFICIAL FUNCTIONS.

Pierre translates the surreality:
This law effectively criminalizes any form of protest. This means that any place or event can, at any time and under any circumstance, be designated a “trespass” area and, anyone protesting any event can potentially be arrested. Knowing also that under NDAA, once arrested, a person can be detained indefinitely and extradited if he or she is deemed a threat, should give us all pause.
Pierre also writes about Obama’s March 16, 2012 National Defense Resource Preparedness (EO 8248).
This order allows the executive branch – through various federal authorities such as the Secretaries of Energy, Health and Human Services, Transportation, Defense, and Commerce – to take control of all food, all energy, all health resources and all transportation resources in the service of “national defense,” even in times of declared peace. It is true that this latest executive order is an update to the one signed by Bill Clinton in 1994. But in the context of the growing number of laws that expand executive and military power to stifle dissent along with the rapidly expanding national security enterprise, we should be wary.
We are a nation of laws. More and more we are a nation of anti-citizen laws imposed by constitutional-law-discarding fascists in Democratic and Republican clothing. Most significant are the monumental and obscene selling-out Democratic Party leaders and their media enablers hypocritically trying to fog out the horror of what is happening.
Obama REAUTHORIZED the Patriot Act of 2001 which has given our fascist leadership what they consider a blank check (an illegitimate one) to do ALL THE UNCONSCIONABLE ACTIONS IT WANTS. Pierre:
... we have seen assaults on our dignity, our human rights and ability to protest. These assaults now come from multiple fronts and contain diverse tactics. And they affect us all. We see examples in the local and federal militarized response to the Occupy Wall Street movements, the deployment of drones domestically by city governments, universities, private contractors, and local police (see domestic drone authorization map here), and we see how the Obama administration has waged an all out war against whistleblowers by using the archaic World War I era Espionage Act, prosecuting more people than all other presidents combined.
More importantly, there is what the Washington Post last year called the “National Security Enterprise” that depends on “854,000 civil servants, military personnel and private contractors with top-security clearances,” and whose major work is domestic surveillance to curtail dissent. The unprecedented $1.5 billion, almost 1 million square feet National Security Agency data center (or “Spy Center”) that is being built in Utah, is to work both as a bottomless database for all information on all Americans, and as a remote interrogation center.
The US government is breaking moral law all over the globe with its military MISADVENTURES. It bullshits about humanitarian intent but look at who ends up governing in said destabilized countries (destabilized with lotsa help from you know who) and which oppressive governments the US is perfectly content to enable. A cabal of international bullies.
We are at the mercy of a government that is committing war crimes now at warp speed.
We are reduced to looking outward at the world and thinking, “Wow, safer to be within U.S. borders than without.” Cold and temporary comfort. If you happen to live in the Middle East or Africa, especially now, you or your nearest and dearest can get incinerated or maimed in a New York second just being in the wrong place at the wrong time. Tidily zapped to red mist by some callow kid at a joy stick in Nevada. Labelled insurgent if your death makes it to any US media, though that is unlikely. Labelled a “bug splat” by whoever is behind the drone killing console screen.  Pierre:
With all of this, it is clear that, even though it seems to only be concerned with international wars and other misadventures, the US government is preparing for domestic insurrection. And it has done so by unleashing the structures of totalitarianism, as it seeks to regulate our actions through mass surveillance, fear, and threats of repression. By the way, Green Party presidential candidate Jill Stein just released a video and statement declaring she will pardon Bradley Manning when elected.
LISTENING BARACK? Of course you are. Well, not you exactly. Creepily, your surveillance apparati is listening.
Dr. Stein is pitting her conscience against the unconscionable anti-American and anti-global-citizens activities of the Obama administration and our mass-murderous government.
Who’s back should we have? Obama’s or Stein’s? I choose Stein’s. The more of us who take that stance the safer Stein and all of us daring to protest will be.

yes, dissent is now criminal. That should give each and every single one of us pause before screaming whether they are on the red team of blue.

The lesser and least of evils has always been our choice... law is an artificial construct of power... insurrection has always been the excuse for kicking diown doors and hauling people off for no particular reason other than their attempts to organize opposition... with any luck the judiciary will strike these "laws" down as unconstitutional, not that that will do any good... enforcement has rarely allowed the spirit of the law to prevent intervention and detention.
This left wing ideology is no different than that from the right. It's appeal is fear and apocalyptic--always the fascist out to get you, the rigid rejection of political reality, the end of all that is holy. If it's not Obama who has disillusioned you it's the next guy or gal. Nobody is going to do it your way and compromise is out of the question. How do you think the fascists actually win? Mission, well put. And yes, I am praying more and more of the citizenry begins to express dissent, so that those on the vanguard of courageous dissent now are not left to twist in the wind at the mercy of the horrifying repealing of our BASIC amendment rights with these anti-constitutional and inhumane and insanely arbitrary to the whim of the governmental leaders laws.

I just heard a wonderful financial analyst and professor on the NewsHour talking about Dodd Frank. Her name is Lynn Stout. Ms. Stout said that what Dodd Frank did, instead of spelling out regulatory law for Wall Street corporations, instead gave the government agencies the power to write and determine regulations. Which of course leaves the agencies susceptible to incredible corporate lobbying and with covert cover to give advantage to their cronies. Hello???? Have we learned nothing from the financial mess? Apparently not.

Ms. Stout also said that Wall Street has cannibalized its customer base out of is grotesque short term addictive greed.

I read today that the labor department is preparing to invoke child labor laws for farm children, meaning the children of the farmer, making it illegal for them to work and earn money on the family farm. It's got to stop somewhere. I wonder what the soldiers are going to do when they're told to fire on their neighbors. Do you know what they're trying to prove with all of this?
jmac, yes police state behavior happens even in a constitutional republic, ignoring laws if the leaders recklessly assert illegitimate power over the military and police. but you know when Bloomberg during the Republican Convention in NYC long ago decided to illegally discourage protesters by having some ambushed while in a permit-authorized march or gathering carted off to jail in plastic zipcuffs justice came later. since then, though with little media attention, countless wronged protesters have received compensation from the courts for the illegal arrests and incarcerations, draining the NYC budget, of course. Apparently it was worth it to Bloomberg to try to freak out protesters to back off from mass protesting with such intimidation for that moment. But the wheels of justice, sometimes grind forward slowly, but with law they can grind forward ... no matter how slowly.

Take away the rule of law like Obama et al. are doing right now, so dramatically and unbelievably, and the wronged have no recourse .... we don't have a citizen welfare constitution-protecting republic, we have FASCISM. WE HAVE TOTALITARIANISM.

phyllis, I have not heard about the child labor deal with farms. would be curious to hear more about it.

I remember hearing Ethan McCord who was the heroic soldier who was part of the Wikileaks Collateral Murder apache crew unit speak in NYC. He had been on the ground when the travesty happened and actually tried to save the lives of the children of the good Samaritan our soldiers shot and killed AFTER our troops had just shot with videogame indifference (recorded dialogue to prove it) the initial innocent targets. The two children had also been shot. They were in the front seat of a truck.

Ethan talked about the profound desensitization training the troops had to go through to be effective killing machines. He turned to the NYC audience and said bluntly, "Don't doubt that we are trained to kill you, too, if it comes to that!" I got a chill.

As the economy unravels, wonder if the only jobs will be for homeland security and military. you get paid only if you are willing to intimidate, lock up and/or kill anyone anywhere, no questions asked. Just follow orders!

I don't the exact whys or what's or hows of this but I know that I saw firsthand that the police have little to no accountability.So many lawyers shake their heads at how hard it has become to be a civil rights lawyer. Most have closed shop. It's nearly impossible to win now, and the civil rights crusader is a thing of the past due to the spate of terrible higher court decisions. So much is going wrong with this country and your outrage is the right response. Sadly, most just won't get it until they GET IT.

The lack of outrage over the repeal of the Bill of Rights might relate to the fact that American high schools no longer teach American history. I wonder how many voters actually know what the Constitution us.

I just don't get it. I grew up with a lot of illusions about justice and the human capacity for empathy. Even when I heard about the Milgram experiments I was grateful 4 out of 10 people said no to orders to use painful levels of electricity to shock innocent strangers because someone in a white jacket was telling them to.

Now it seems like less than 4 out of 10 is willing to step up to the plate and exercise empathy and responsibility and challenge the appeasers and surrenderers who seem to be yawning as our rights finish circling the bowl!!!! I have a new coinage, American "settlers". The exact opposite of our feisty pioneer ancestors!!! American "doormat-ism"!

Satirists Ilf and Petroff successfully published outrageous send-ups of the Stalinist bureaucracy in the Soviet Union, providing great emotional nourishment to the populace during the darkest days of Soviet oppression. This writing team succeeded by avoiding direct political criticism and keeping the focus on the most immediate problems of everyday life. They were so clever and amusing that the stodgy thought police never caught on, which added to the duo's subversive popularity. One of their most famous stories is The Twelve Chairs, which Mel Brooks made into a hilarious movie in the early '70s. Long way to say, this is my kind of dissent. It's what I try to do in my own modest way. If done right it can have more effect on rallying peoples spirits than bluster and bombast.

Of course, the big money foresees dire economic consequences ahead that will lead to hunger and homelessness, and it must protect itself. Have you noticed how many laws are being put in the books in anticipation of dissent and how quickly they are being passed even though they are all unconstitutional? Why did the Congress pass unconstitutional laws?

I would like to point out that Obama (himself) really has nothing to do with any of it. Any other president would have done the same. Every president since FDR has some specific tasks to fulfill, and preparing for domestic insurrection is one of Obama's. But I do take issue with you on one point, my friend. All of us are personally responsible INCLUDING OBAMA AND ESPECIALLY OBAMA for what is happening to this country. I am stunned that even people like you who have the administration's number so well are excusing the new-mode teflony prez for doing what he is forced to do.

Anyone would do it? Jill Stein wouldn't do it! But who are the American "settlers" standing by, Obama!!! Let's identify totally with our oppressors????? Learned helplessness? They don't even have to assert violence, the police state, even though they are preparing to anyway. People will flock to vote for Obama in fear of those awful Republicans getting power. The Repubs would be hard pressed to do matching levels of damage as Obama! Once again I find that however little time I have, I need to make time to read your posts. We are coming at the same conclusions from opposite ends of the political spectrum, but from exactly the same spot on the Spirit, Free Will, Individual and Human Rights issues. It may sound "off-putting", but give a listen to Rush Limbaugh and Neil Bortz-- Two people who, no matter what else you think of them, have denounced Obama and, believe it or not, his plutocrat buddies as dangerous traitors. And are probably the "Terrorists" that Obama and company are gearing up to arrest (or kill)

What is interesting is the "resonance " this strikes in the "Heartland" and in the military. It is the difference between those who have and respect "Honor" and "Free Will" and "Justice" and those who don't.

I live within 200 yards of the fence of the largest air force base in the world ( Wright Patterson) and, as you know, am having my differences with the civil authorities here in Fairborn over the treatment of my neighbor, Mike.

The thing that is reassuring here, is that the police are staying out of it. Mike has a Bench Warrant out, that the Chief of Police is very aware of, and has decided he wants no part of. At this point, The court wishes it had never started, and is hoping Mike will just go way, to be picked up when things cool down.

All this to say, that The Chief has a town full of cranky Airmen who are armed, and no doubt that, in the event of any major upheaval, the town will be under Martial Law before he knows about it.

Which isn't a bad thing-- The military and ex-military around here are pretty much "Oath Keepers"- they know illegal orders, and the Nuremberg Laws quite well. I know that Obama and his cronies are are "Commanders" in Chief- but it will be "interesting" to see, when push comes to shove, whether , like the Pope, he actually has or has not the military strength, or the obedience, to "take the Red States"- which is what it may come down to.

One of the joys of a "small town" is being able to know and motivate your neighbors.

When I came across Pierre's article earlier today about the horrifying anti-dissent legislation I needed to pass the info along as well as express my own outrage.

I love the idea that we are coming from opposite ends of the political spectrum, but "from exactly the same spot on the Spirit, Free Will, Individual and Human Rights issues."

You know to be honest I think Obama hates ex-hippie liberals like me a helluva lot more than he does the Rush Limbaughs and the red staters. But I hear what you are saying, .... still .... Rush ... I can't abide him, at least what I have heard about and from him He has had avid fans among some of my secondary family which I found worrisome. (Howard Stern makes me crazy, too. Imus was disturbing. A political palette of shock jocks. And Morning Joe .... tv blowhard .... blecccccchhhhhh.)

I remember reading that when JFK entered the matrix what really helped him was RFK whom he almost didn't appoint as AG but he had his back and broke the "group-think" that I am sure Obama and Bush Jr. walked into. I expected Bush to succumb to it, but Obama has really gone the distance for the ruling elites.

The Green Party structure could really shake up the election but citizens are just not motivated to challenge the Dem Party. I can't believe how obtuse they are being. In the past 5 decades, every important legislation that passed benefited the big money; the rich are getting richer and the poor are getting poorer come rain or shine.

The Wall Street bailout was used to pay salaries and bonuses to the big thieves and restore the banks' losses. The banks did not and are not giving out loans. Bush, Obama, and the Congress did that. Nothing ever did or will ever happen that will top that corruption. This is beyond fiction.

In fact, Obama was the last straw; he confirmed my cynicism. I was and still in awe of how helpless he is acting. Why do you think he did not fulfill any of his campaign promises? I know he is a slick politician from Chicago, but I do not think he is evil enough to cut social security and Medicare. He did and he will cut more.

I wish I could believe that the president or the congress have power...any power, except of course over the poor and the sick. I am sorry, but the evidence is so disappointing. I wish I am wrong. Thoth, you'll get no argument from me that Obama seems to have a dazzling personality. I am talking about character. It dumbfounds me that he is defended. I don't know honestly if he is an authoritarian or an authoritarian follower. Maybe the second turning into the first. I feel sorry for Obama. But I can't afford too much pity because he is so dangerous. Yes, you say, anyone in that situation being controlled by the corporate puppeteers, pimping for them would be helpless. But he chose to be their frontman and that was a proactive, well rewarded decision. And I say, to get on board to be pimped by them is a character flaw. Obama is certainly not alone with a character flaw, But he is the Character-Flawed-In-Chief. Even Obama said to make him do right we should put his feet to the fire. And yet, the fact that I have what I feel is a healthy anger at someone contributing as a significant catalyst in disasters happening to people in this country and out is not out of line.

Obama, first and foremost, is little more than a kind puppet face doing the bidding of his master while putting on a great show to his audience showing how much he 'cares' as he signs bill after bill cutting our supposed freedoms...
We are all at a very dangerous state here.
either we can turn on each other like dog packs taking sides or we can see the bigger picture.
Laying blame and personal attacks are little more than sidetracks leading to dead ends.
Alerting each and all to the REAL threats going on while mainstream media blurs the lines in giving out the latest over down crime spree or Hollywood/Disney scenario and distracting the masses is the bread/circus propaganda routine.

The threat is real. CIPSA has passed and been amended. Even with the threat of veto the dearth of bad news continues.
